These Terms and Conditions ("Agreement") govern your access to and use of the website operated by Jamey Raves ("the Artist"). By accessing the Site, you ("User") agree to be legally bound by this Agreement.

1. OWNERSHIP OF INTELLECTUAL PROPERTY

The Site contains proprietary content including, but not limited to:

 * Musical Works: Song ideas, unedited recordings, demos, and audio stems.

 * Literary Works: Poems, lyrics, thoughts, and blog entries.

 * Visual Works: Photography, "sneak peek" video footage, and personal imagery.

All such materials are the exclusive property of Jamey Raves and are protected under United States and International Copyright Laws. The Artist reserves all "Moral Rights" and rights of publicity associated with the stage name Jamey Raves.

2. RESTRICTIONS ON USE

The Artist grants you a limited, non-exclusive, non-transferable, revocable license to view and listen to the content for personal, non-commercial use only. You are expressly prohibited from:

 * Sublicensing or Redistribution: You may not upload, "rip," or distribute any audio or text to third-party platforms (e.g., Spotify, YouTube, SoundCloud).

 * Sampling and Derivative Works: Any unauthorized sampling, remixing, or transformation of the Artist’s "song ideas" or "unedited recordings" is a direct infringement of copyright.

 * AI Training: You are strictly prohibited from using any content on this Site (text, audio, or image) to train, fine-tune, or prompt generative Artificial Intelligence (AI) models.

3. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE

If you believe that any content hosted on this Site infringes upon your copyright, please submit a written notification to the Artist. Conversely, the Artist aggressively monitors for infringements of the Work found on this Site and will issue DMCA takedown notices to any platform hosting stolen content from this Site.

4. CONTENT DISCLAIMER ("AS-IS")

The Site serves as a “look into the creative process.”

 * Unedited Content: Audio may contain artifacts, peak distortion, or raw language. The Artist makes no warranties regarding the technical quality or fitness for a particular purpose of any “song idea.”

 * Personal Life Content: Information regarding the Artist’s personal life is shared for fan engagement and does not constitute a waiver of the Artist’s right to privacy. Use of this information for "doxxing," harassment, or defamatory purposes will be met with legal action.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by Idaho law, Jamey Raves shall not be liable for any indirect, incidental, or consequential damages (including but not limited to loss of data or hardware damage) resulting from the use or inability to use the Site.

6. INDEMNIFICATION

User agrees to indemnify, defend, and hold harmless Jamey Raves from any claims, losses, or expenses (including reasonable attorney's fees) arising from User’s violation of this Agreement or the unauthorized use of the Artist’s Intellectual Property.

7. GOVERNING LAW AND VENUE

This Agreement is governed by the laws of the State of Idaho. Any legal action, suit, or proceeding arising out of or relating to this Agreement shall be instituted exclusively in the state or federal courts located in Idaho.

8. SEVERABILITY

If any provision of this Agreement is held to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
